This Privacy policy governs the processing of personal data by CHETTA-JONES CONSULTING, a private limited company established at 3590 Diepenbeek, Vlierstraat 61, registered in the KBO register under number 0736.620.968, known under the trade name The C Effect, info@the-c-effect.com (email) hereinafter referred to as "Chetta-Jones Consulting”.

 

This Privacy policy is in accordance with the General Data Protection Regulation of 24 May 2016 concerning the protection of privacy in the processing of personal data and the Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data, and explains what personal data Chetta-Jones Consulting collects and how it uses them. Please read this Privacy Statement carefully, as it contains essential information on how your personal data is processed.

 

Chetta-Jones Consulting respects your privacy and your rights to control your personal data and to understand how it is processed.

 

  1. Personal data

As a data controller, Chetta-Jones Consulting processes data that you voluntarily provide in the context of its customer management, when placing an order on the website, subscribing to the newsletter, or to stay informed about its services, within the framework of a collaboration, or data that is necessary for the performance of the (online) services offered by Chetta-Jones Consulting.

Specifically, Chetta-Jones Consulting may process the following personal data: name, first name, date of birth, address, email address, telephone number, bank details, etc.

Chetta-Jones Consulting takes the processing of your personal data very seriously and strives to implement the necessary technical and organizational measures to protect your personal data and help prevent theft, misuse, and unauthorized access, disclosure, alteration, and destruction of your information.

 

All service providers of Chetta-Jones Consulting are bound by confidentiality regarding the personal data provided, and a password policy, firewall, and antivirus are applied on all systems.

 

Chetta-Jones Consulting regularly monitors its systems for potential security risks and attacks. However, it cannot guarantee the security of data you send. In the event of a breach, prompt action will be taken and the parties involved will be informed in case of a serious breach. Chetta-Jones Consulting cannot be held liable for direct, indirect, or consequential damages caused by incorrect or unlawful use of personal data by a third party.

 

The collected personal data is stored and processed in Belgium, at the headquarters of Chetta-Jones Consulting, or by external service providers, also located in Belgium or Europe. The collected data is transferred only over a secure connection from the website to the server.

 

Some data is stored and processed by external service providers outside the European Union. If data is processed by service providers with servers outside the European Economic Area, Chetta-Jones Consulting assumes that an equivalent level of protection as within the EU is applied. Where necessary, appropriate safeguards are used under Article 46 GDPR, such as standard contractual clauses with additional guarantees (e.g. encryption or pseudonymisation of personal data with the encryption key remaining in the EU), and adequacy decisions under Article 45 GDPR.

Chetta-Jones Consulting guarantees a similar level of protection by making contractual obligations enforceable against these employees and appointees. 5. Processing purposes

a) Customer management

The data collected by Chetta-Jones Consulting is processed for the registration and management of a customer account. This includes processing your personal data to register an account, manage customer information, handle orders and payments, and communicate with customers.

 

b) Supplier management

Furthermore, personal data is collected for the purpose of managing relationships with suppliers. Their personal data is processed for placing orders, concluding contracts, and enabling communication with suppliers. Additionally, their personal data will also be further processed within the framework of the collaboration necessary for this (execution, invoicing, payment, etc.).

 

c) Webshop

The data collected by Chetta-Jones Consulting is processed for the use of its webshop. The personal data is processed to handle orders and receive payments. This includes, among other things, providing order confirmations, shipping updates, and invoices. Furthermore, the collected data is also used to assist customers with questions and complaints.

g) Security, dispute resolution, and legal compliance finally

Chetta-Jones Consulting aims to ensure security and safety. Data may also be used in the context of dispute resolution, fraud detection, legal purposes, and to comply with applicable laws.

The collected personal data is processed on the following legal grounds: Article 6.1.a GDPR (consent), Article 6.1.b GDPR (necessary for performance of a contract), Article 6.1.c GDPR (necessary for compliance with a legal obligation), and Article 6.1.f GDPR (legitimate interests).

 

Depending on the processing purposes described above, the processing will occur as follows:

  • Customer and supplier management: Based on Article 6.1.b of the GDPR (necessary for the performance of the contract). You are not obligated to provide the necessary personal data for the performance of the contract to Chetta-Jones Consulting. However, please note that without this data, Chetta-Jones Consulting Belgium will not be able to provide certain services or fulfill certain agreements.

  • Webshop: based on Article 6.1.b GDPR (performance of a contract).

  • Direct marketing: social media and newsletter: ased on Article 6.1.a of the GDPR (consent) and Article 6.1.f of the GDPR (legitimate interests). You can give this consent by ticking the checkbox in a banner at the bottom of the website. If you give your consent, you are free to withdraw it at any time. However, processing of your personal data may still continue based on Article 6.1.f (legitimate interests).

  • Contact form: based on Article 6.1.a GDPR (consent).

  • Security, dispute resolution, and legal compliance: Based on Article 6.1.c of the GDPR (necessary to comply with a legal obligation incumbent on the data controller) and Article 6.1.f of the GDPR (legitimate interests) to exercise our right of defense.

 

7. Retention Period

Depending on the purpose of processing, the personal data processed by Chetta-Jones Consulting will be retained for as long as necessary to achieve the purposes for which the data was collected and to enable Chetta-Jones Consulting, among other things, to comply with its legal and accounting obligations.
Personal data processed for direct marketing purposes (social media) and data provided through the contact form will be retained for a maximum period of 1 year. Personal data related to website widgets will be retained for a period of 2 years. Data collected in the context of customer and supplier management will be retained for a maximum retention period of 10 years.

 

8. Rights and Complaints of the Data Subject

As a data subject, you have the right at any time to access the personal data processed by Chetta-Jones Consulting as the data controller and to have them corrected if they are inaccurate or incomplete, to have the data transferred, to restrict their processing, or (under certain circumstances) to have them deleted. Furthermore, you also have the right to object free of charge to any processing of personal data for direct marketing purposes. You can withdraw your consent for marketing-related emails sent to you by email via the link at the bottom of each email you receive.

 

Chetta-Jones Consulting does not use data that is processed solely by automated means (such as profiling).

 

Since the processing of personal data is also based on Article 6.1.a of the GDPR (consent), you always have the right to withdraw your given consent. However, please note that if you do not give consent to process certain personal data, you will no longer receive relevant information.
